Appealing OHS Orders
The Occupational Health and Safety Council advises the Minister of Alberta Employment and Immigration on matters concerning the Occupational Health and Safety Act and on matters related to the health and safety of Alberta workers. The Council is empowered to hear appeals of orders issued by Occupational Health and Safety.
The issues that can be appealed before the Council are:
- Orders issued by Occupational Health and Safety
- The cancellation or suspension of a licence or permit
- A ruling from a dismissal or disciplinary complaint investigation
- A ruling from an imminent danger complaint investigation
Matters the Council does not handle involve:
- Mediation
- Employment standards
- Wrongful dismissal outside of OHS legislation
- Grievances
- Workers’ Compensation Board (WCB) claims
- Human rights
- Employment insurance disputes
- Employment standards claims, workplace health and safety, and labour relations issues under federal jurisdiction
